Too often, a person charged with drunk driving believes that there is no defense to a drunken driving charge. In fact there are many defenses and it is important for your case to be reviewed by a qualified attorney to determine whether your case could be challenged.
Police officers may stop drivers merely because of the time of day. This could include parking outside bars looking for drunk driving offenders, checking license plates for drivers with outstanding tickets. Police can stop you based upon "swerving within the lane," obstructed vision claims, and loud radios or exhausts. The pretext for the stop is designed to justify an investigation. An officer requires "reasonable suspicion" to stop a vehicle, or the officer must actually witness a motor vehicle infraction.

DWI/DUI Laws and FAQ’s
How Long Can I Lose My License?
First offense DWI
First offense DWI is a class B misdemeanor and involves a fine up to $1,200 plus a 24% penalty assessment and a minimum mandatory of license suspension 90 days with a potential license loss up to two years. The length of suspension will depend on your driving record and the details of your arrest. You will also be required to take an Impaired Driver Program and successfully complete that program, pay a restoration fee to DMV, provide SR-22 insurance. There is also a mechanism to subsequently reduce the misdemeanor to a violation level offense.
If you are under the age of 21 there are also enhanced penalties in addition to the above penalties, most notably a minimum one year loss of license.
Second Offense DWI
If you are charged with DWI a second or subsequent time it is a class A misdemeanor. This has enhanced penalties from a first offense, including mandatory jail time, increased fine and three year loss of license. The state requires you to take an Alcohol Education Class at an approved treatment center. Second and subsequent DWI offenses are very costly.
If convicted of aggravated DWI you will be facing a class A misdemeanor. An aggravated DWI is a separate class of DWI in that it contains additional elements that are considered more serious. For example a BAC .16 or higher, excessive speed, reckless driving or disobeying an officer. As a result you will have a higher fine, longer minimum mandatory license suspension (1 year) suspension, and mandatory jail (10 days).
Some DWI's can be felonies with more serious consequences, up to and including state prison terms and lifetime loss of license.
In addition to all the above penalties there are also administrative DMV suspensions that you face can be independent of court ordered suspensions of at least 6 months based on whether you refuse a breath or blood test or if you provide a sample of at least .08 (.02 for those under 21). These suspensions increase to 2 years if there is a prior conviction or administrative suspension within the last 10 years.
